Terms of Service

These terms are an agreement between TEKTUNE ("TEKTUNE", "we", "us") and the business that subscribes to TEKTUNE ("your shop", "you"). By creating an account, subscribing or using TEKTUNE, you agree to them on behalf of your shop and confirm you're authorized to do so. People your shop invites (your "users") must also follow them.

1. The service

TEKTUNE is web software for running an auto repair shop: a task board, loaner and rental fleet, inspections, electronic rental agreements, messaging, time off, time clock, reports and related features ("modules"). Which modules you can use depends on your plan. We may improve, change or retire features over time; if we remove something central to your plan we'll tell you in advance.

2. Accounts and security

Your shop's administrators control who has access and what each role can see. Each person must use their own sign-in and keep their password private; PINs are only a quick switch on devices already signed in by your shop. You're responsible for activity under your shop's accounts and for telling us promptly about any unauthorized use. We may require sign-in codes on new devices and other security steps.

Everything your shop and its users put into TEKTUNE - employee details, vehicles, photos, messages, rental agreements and customer documents - is your shop's data and stays yours. You give us permission to store and process it only to provide, secure and support TEKTUNE for you. You're responsible for having the right to collect it, including any notices or consents your customers and employees need (for example, before photographing a customer's license or texting them). 5. Acceptable use

Don't use TEKTUNE to break the law, to send spam or messages people haven't agreed to receive, to upload malware, to try to reach another shop's information, to probe or overload the service, or to copy or resell it. We may suspend an account that puts the service, other shops or the public at risk, and will tell you why.

6. Electronic rental agreements

The rental agreement's content is your shop's; TEKTUNE provides the signing process and keeps a tamper-evident signing record and certificate. Electronic records and signatures made through TEKTUNE are intended to meet the Ohio Uniform Electronic Transactions Act (Ohio Revised Code Chapter 1306) and the federal E-SIGN Act, which give them the same legal effect as paper and ink. You're responsible for your agreement's terms and for deciding whether an electronic signature suits each rental. TEKTUNE shows the license and insurance photos your customer provides; it does not verify that those documents are genuine.

7. Text message (SMS) program terms

The TEKTUNE text message program sends:

Messages are transactional; TEKTUNE doesn't send marketing texts. Message frequency varies - typically one to three messages per rental, and one per sign-in on a new device. Message and data rates may apply according to your mobile plan.

To stop receiving texts, reply STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END or QUIT) to any TEKTUNE message, or ask in plain words ("please stop texting me") - you can also email [email protected] to be removed. You'll get one confirmation and no further texts from TEKTUNE. To start again, reply START. For help, reply HELP, contact [email protected].

Participating carriers include AT&T, T-Mobile, Verizon Wireless, UScellular and other major US carriers. Carriers are not liable for delayed or undelivered messages. You must be the account holder or have the account holder's permission to use the mobile number you provide, and you agree to tell us if you give up that number. How we handle your number is covered in the Privacy Policy: we do not sell, rent or share mobile numbers with third parties, and never share mobile opt-in information for marketing.

Shops using TEKTUNE agree to text customers only after getting their consent as described above, and are responsible for complying with the Telephone Consumer Protection Act and other laws that apply to their communications with their customers.

8. Integrations

Some features connect to services you use, such as Tekmetric, Bouncie, Stripe or Microsoft. Your use of those services is governed by their own terms; we aren't responsible for them, and a feature that depends on one may stop working if that service changes or your access ends.

9. Ownership and feedback

TEKTUNE, including its software, design and name, belongs to us and our licensors; your subscription gives your shop a non-transferable right to use it while it's active. If you send ideas or feedback, we may use them without obligation to you.

10. Cancelling and ending service

You can cancel any time as described above. We may end service with 30 days' notice, or immediately for a serious breach of these terms. After an account closes, contact us within 30 days for an export of your shop's data; after that we may permanently delete it (a final backup may be kept for a limited time before it's destroyed).

11. Disclaimers

We work to keep TEKTUNE available, accurate and backed up, but it is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. GPS locations, inspections, reports and reminders are aids - your shop remains responsible for its vehicles, customers, employees and legal obligations.

12. Limitation of liability

To the extent the law allows, TEKTUNE won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, and our total liability for any claim is limited to the amount your shop paid us in the 12 months before the claim. You agree to defend and indemnify TEKTUNE against claims arising from your shop's data, your agreements with your customers, or your breach of these terms.
